🚨 F-1 & J-1 STUDENTS: THE DS RULE JUST GOT BLOCKED.
A federal judge in Boston has postponed the DHS Duration of Status rule—just ONE DAY before it was scheduled to take effect.
So, what does that mean for international students and exchange visitors?
For now, the old system stays in p… lace.
That means:
✨ No 4-year admission cap
✨ No new USCIS extension-of-stay requirement for students needing additional time
✨ F-1 students keep the 60-day post-completion grace period
✨ The new Duration of Status requirements are not currently being implemented
On September 14, U.S. District Judge F. Dennis Saylor IV issued a preliminary injunction preventing DHS and ICE from implementing the rule while the litigation continues.
⚠️ But this is not the final word. The court has not yet ruled on the merits of the underlying challenge. DHS may appeal, and the litigation will continue.
What should students do?
Don’t panic—and don’t make unnecessary changes based solely on the now-blocked rule. Continue following the requirements of your current F-1 or J-1 status and stay connected with your DSO or responsible officer.
And if you’re preparing an immigration filing, check USCIS for the latest form and filing guidance before submitting anything.

A federal judge has struck down the Trump administration’s blanket pause on immigrant visas for nationals of 75 countries—including Togo, Burkina Faso, Nigeria, Ghana, Sudan, Somalia, Haiti, Brazil, and more.
The court called the policy “paten… tly unlawful” and ordered a return to individualized, case-by-case visa adjudication.
This is a major victory—but the government could still appeal.

A U.S. District Court judge has cleared the way for the Trump administration to end Temporary Protected Status (TPS) for approximately 5,000 Ethiopians living in the United States.
📌 What’s Happening:
The judge denied a request to pause the termination while a legal challenge… moves forward. The decision allows the administration to proceed with ending TPS protections for Ethiopian nationals.
📌 Why It Matters:
TPS provides eligible individuals with temporary protection from deportation and authorization to live and work in the U.S. The protections for Ethiopians were previously extended because of the ongoing conflict in Ethiopia, this ruling could impact the lives of thousands.

USCIS has announced a major policy update that takes effect immediately for requests pending or filed on or after August 5, 2026.
📌 What's Changing:
USCIS may now deny certain immigration benefit requests without first issuing a Request for Evidence (RFE) or Notice of Inten… t to Deny (NOID) if applicants fail to submit required initial evidence or establish eligibility when they file.
📌 Why It Matters:
Submitting an incomplete application could now result in a denial without the opportunity to provide additional evidence. Filing a complete and well-documented application is more important than ever.

The Ninth Circuit Court of Appeals has issued a major ruling that could affect immigration detention across the western United States.
📌 What's Happening:
The court rejected the government's interpretation of immigration law that allowed many immigrants to be held in mandator… y detention without the opportunity for a bond hearing. As a result, many detained individuals in the Ninth Circuit may once again request a bond hearing before an Immigration Judge.
📌 Why It Matters:
The Ninth Circuit is now the fifth federal appeals court to reject the government's interpretation, while two other circuits have ruled in the government's favor.

The Department of Homeland Security (DHS) has announced a major change to the U.S. asylum process. Effective immediately, USCIS may now refer certain affirmative asylum applications directly to an Immigration Judge without first conducting an asylum interview.
📌 What's C… hanging:
The new interim final rule allows USCIS to bypass the asylum interview for certain applicants and send their cases directly to Immigration Court. According to DHS, the change is intended to reduce the asylum backlog and speed up case processing.
📌 Why It Matters:
For many asylum seekers, the USCIS interview has long been an important opportunity to present their claim before an asylum officer. Under this new rule, some applicants may instead have their case heard first by an Immigration Judge.
