A trademark is any word, name, symbol, device or any combination, used in commerce to identify the source and distinguish the goods of one manufacturer from the goods of others. Copyright is a form of protection grounded in the US Constitution and granted by law for original works of authorship fixed in a tangible medium. Copyright covers published and unpublished works. A trade secret is a confidential information that is of independent economic value because it is not generally known or readily ascertainable.
We counsel clients in obtaining, maintaining and enforcing trademark and copyright rights. Protective services include research, opinions on availability and registration of trademarks, filing and prosecuting trademark and copyright registration applications, monitoring trademark infringement use, addressing actual or potential infringement cases through cease and desist letters and other dispute resolution strategies.
Attorney Karine Sokpoh has experience with the trademark registration process with the European Union trademark office (Office for Harmonization in the Internal Market “OHIM”) and handles trademark prosecution and enforcement work under the Madrid Protocol and Madrid Agreement. She also assists clients with the commercialization of intellectual property assets by performing due diligence in pending acquisitions and conducting intellectual property audits. Karine has experience drafting and negotiating licenses, assignments, sale and purchase agreements, joint venture agreements, supplier and distributor agreements. She represents clients in UDRP or domain name disputes.
